Terms of Service

These terms are the agreement between you and MerchReal (merchreal.com, "we") for using the service. By creating an account or using MerchReal you accept them. If you don't agree, please don't use the service.

1. What MerchReal does

MerchReal uses AI to create product photos and, if you choose, listing texts for print-on-demand products from the photos, mockups and print files you upload. The service is in beta: features may change and it may sometimes be unavailable.

2. Your account

• You must be at least 18 years old.
• One account per person. Use an e-mail address you own and keep access to it: we send your sign-in codes there.
• You are responsible for what happens in your account. Tell us at support@merchreal.com if you think someone else has accessed it.

3. Credits and free trial

• Generating photos uses credits. The price of each generation is shown on the button before you start.
• New accounts may get free trial credits once. Trial photos are 1200 px and carry a small "MerchReal" mark. Creating extra accounts to get more free credits is not allowed, and we may remove those credits or accounts.
• If a generation fails and you get no photos, the credits for it are returned automatically.
• Credits don't expire. They belong to your account and can't be transferred or exchanged for cash.

4. Buying credits

• Credits are sold in one-time packs. There is no subscription and nothing renews automatically.
• Prices are shown in US dollars. Sales tax or VAT is added at checkout where it applies, depending on where you are.
• Payments are processed by Stripe. For credit purchases Stripe (through its company Link) acts as the merchant of record: it is the seller on your receipt and handles payment, sales tax and VAT. Your card details go to Stripe and never reach us.
• Credits are added to your account right after the payment succeeds.

5. Refunds

• A pack you haven't used yet can be refunded in full within 14 days of purchase. Write to support@merchreal.com from the e-mail of your account.
• Credits are digital content that is delivered at once. By buying a pack you ask us to deliver it immediately and agree that, once you start using its credits, you lose the 14-day right of withdrawal for that pack. A pack that has been partly used isn't refunded.
• Credits for generations that fail are returned automatically, as described above. If something went wrong with a result, write to us: we look at every case.
• If a payment is refunded, the credits from it are taken back from your account.

6. Your content

• You keep all rights to what you upload. You confirm that you have the right to use it: your own designs and photos, or ones you have permission to use. Don't upload other brands' logos, characters or designs, or other sellers' mockups and photos, without permission.
• You give us permission to store and process your uploads only to provide the service to you, including sending them to our AI providers to create your photos. We do not use your content to train AI models.

7. The photos and texts we generate

• You may use the generated photos and texts for your listings, shop and marketing.
• AI results can contain mistakes. Check every photo and text before you publish it. Make sure the photos show your real product fairly (print, colors, size and placement) and follow the rules of the marketplace you sell on.
• Similar prompts can produce similar results for other users, so we can't promise that a result is unique.

8. Things you must not do

• Upload or create illegal content, content that infringes other people's rights, hateful content, or any sexual content involving minors.
• Use MerchReal to mislead buyers, impersonate others or sell counterfeit goods.
• Try to break, overload, scrape or get around the limits of the service, or abuse free credits.

We may suspend or close accounts that break these rules.

9. Availability and liability

We work to keep MerchReal running well, but in beta the service is provided "as is", without guarantees that it will always be available or error-free. To the extent the law allows, we are not liable for indirect losses such as lost sales or profits, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer under the law of your country.

10. Ending the agreement

You can stop using MerchReal at any time and delete your account in Settings → Delete account. We may end the service for an account that breaks these terms, or stop the service as a whole with reasonable notice. If we stop the service as a whole, we refund the credits you bought and haven't used.

11. Changes and law

We may update these terms. For important changes we will tell you in the app or by e-mail before they apply. These terms are governed by the law of Poland, without taking away the protection that the law of your country of residence gives you as a consumer.
